Overview
These Terms of Service ("Terms") govern your use of shop.ummyshakes.com (the "Store") and any purchase of Ummy® Kids Superfood Shakes. By accessing or using our Store, you agree to these Terms. If you do not agree, please do not use our Store.
About Us
The Store is operated by Superfood Organics LLC dba Ummy®, a California limited liability company located at 301 East Arrow Hwy, San Dimas, CA 91773. References to "we," "us," or "our" mean Superfood Organics LLC.
Permitted Use
You may use our Store solely for lawful, personal, non-commercial purposes. You must be at least 18 years old — or the age of majority in your jurisdiction — to place an order. By purchasing, you represent that you meet this requirement.
Prohibited Use
You agree not to: use the Store for any fraudulent or unlawful purpose; resell or redistribute our products without written permission; scrape, crawl, or data-mine the Store; attempt to gain unauthorized access to any account or system; or post false, misleading, or defamatory content.
Product Purchases
All prices are listed in US dollars and are subject to change. We reserve the right to limit quantities and to refuse or cancel orders at our sole discretion. Title and risk of loss transfer to you upon delivery to the carrier. We are not responsible for carrier delays or lost packages resulting from incorrect shipping addresses entered at checkout.
Toddler Guidelines
Ummy® Kids Superfood Shakes are formulated for children ages 1 and up, but are not intended to replace breast milk, infant formula, or a varied diet. For children under 2, consult your pediatrician before introducing any new food or beverage product. Always supervise young children while consuming any beverage.
Subscriptions
Subscribe & Save orders ship automatically every 4 weeks at the discounted subscription price in effect at the time of each shipment. You may pause, modify, or cancel your subscription at any time from your account dashboard before the next billing date. We reserve the right to modify subscription pricing with 30 days' notice to your email on file.
Refunds
Our refund and returns policy is described in full on our Refund Policy page. Due to the perishable nature of our products, all sales are final except in cases of damage, defect, or error on our part.
Intellectual Property
All content on the Store — including the Ummy® name and logo, product imagery, copy, and design — is owned by Superfood Organics LLC or its licensors and is protected by US and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
Privacy
Your use of the Store is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Disclaimer of Warranties
Ummy® products are not intended to diagnose, treat, cure, or prevent any disease. Nutritional statements have not been evaluated by the FDA. The Store and its content are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted access.
Limitation of Liability
To the fullest extent permitted by law, Superfood Organics LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Store or products, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the order in question.
Choice of Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.
Changes to These Terms
We may update these Terms from time to time. The "Effective" date above will reflect the most recent revision. Continued use of the Store after changes constitutes acceptance of the revised Terms.
